Judge explains why he acquitted road rage accused

... a judge has to be a detached adjudicator and the prosecution has to prove its case. 'The danger...is that having formed a position, a judge's ability dispassionately to consider the evidence is compromised.'

Prosecution to contest acquittal

THE prosecution is hoping to get another crack at Mr Ng Chee Tiong.
While less serious cases like his usually end in the High Court, prosecutors have, in a rare move, filed a motion to have the case heard in the Court of Appeal. They contend public interest is at stake.

The prosecutors plan to argue whether the conviction should have been quashed just because the district court judge peppered Mr Ng with questions 'beyond what she ought to have done' during his first trial. They claim the questions did not 'impede' the defence.

In explaining his decision to acquit Mr Ng, Justice Lee Seiu Kin said the offence was not a serious one, the evidence was not certain and Mr Ng would suffer prejudice if he were to be re-tried.

'To order a retrial in these circumstances would mean that the prosecution would have a second bite of the cherry,' he said.

Before the case makes it to the Court of Appeal, the prosecutors must seek leave in the High Court. Their application will be heard next month.
